Terms of Rental
In order to use the rental service, the Client must become acquainted with the following Terms and Conditions and accept them.

Definitions
The following words and expressions used in Terms and Conditions shall have the following meanings:
1. – ICT system designation which enables contact via electronic means of communication,
2. – all information regarding an identified or identifiable physical person and processed by Booking System Owner in order to adequately provide Services defined in these Terms and Conditions, as well as for statistic purposes related to the business activity run by Intermediary,
3. – all information directly or indirectly intended for the promotion of Suites for rent offered by visit baltic Beata Barkas, services or image of visit baltic Beata Barkas, except for information enabling contact via electronic means of communication with a specific person and except for for information about goods and services not contributing to commercial effect desired by the entity commissioning its broadcast, in particular without any remuneration or other benefits from manufacturers, vendors and service providers,
4. – a physical person, legal person, organizational unit with legal capacity and public institution and budgetary units, who is a service user within the meaning of Article 2 item 7 of, using Services offered by visit baltic Beata Barkas,
5. – law applicable in the Republic of Poland,
6. – – regulations pertaining to the protection and processing of personal data applicable in the Federal Republic of Germany, defining the duties of entities which process data,
7. visit baltic Beata Barkas – visit baltic Beata Barkas Barkas with its registered seat in Świnoujście, ul. Wojska Polskiego 4ab/5a, 72-600 Świnoujście, Tax ID (NIP) 8551370323
8. – entity through which Client uses Services offered by Solutions – 'Wild-east Marketing' GmbH Ringstraße 18 18528 Bergen auf Rügen.
9. – these Terms and Conditions of visit baltic Beata Barkas on-line booking platform. Terms and Conditions are available free of charge at www.visitbaltic.pl
10. – (Allgemeinen Geschäftsbedingungen) defined by Booking System Owner in the scope of Personal Data, made available at www.im-web.de during Booking, binding for Client from the moment of acceptance thereof in the course of Booking.
11. – a system comprised of cooperating IT devices and software, ensuring the processing and storage as well as sending and receiving of data via telecommunications networks by means of a terminal device appropriate for the particular network type within the meaning of Telecommunications Law Act of 16 July 2004 (Journal of Laws of 2004 no. 171, item 1800 as amended).
12. – technical solutions, including ICT equipment and cooperating software tools, enabling individual remote communication using data transfer among ICT Systems, e-mail in particular.
13. – apartments/premises proposed for rent, located at the territory of the European Union, where short stay is offered, are published atwww.visitbaltic.pl
14. – an agreement on short-term rental of a Suite, concluded by and between Client and visit baltic Beata Barkas as of the moment when visit baltic Beata Barkas confirms the booking process.
15. – activities leading to Client Booking a Suite via www.visitbaltic.pl, which includes the conclusion of Contract.
16. – Act of 18 July 2002 on Providing Services by Electronic Means (Journal of Laws of 2002 no. 144, item 1204 as amended).
17. – Service consisting in making a suite rental reservation by Client via www.visitbaltic.pl, based on which Client is going to conclude Contract with visit baltic beata Barkas.

General provisions
1. These Terms and Conditions define the following:
1. the rights and duties of Client and visit baltic Beata Barkas related to the provision of Services by electronic means and with Contract conclusion,
2. the rules of Booking via www.visitbaltic.pl and the rules of concluding Contract,
2. visit baltic Beata Barkas provides Services by electronic means via www.visitbaltic.pl website, in accordance with Terms and Conditions,
3. Client shall comply with the provisions of Terms and Conditions from the moment of taking action aimed at using Services provided by www.visitbaltic.pl website

Conditions of provision of services by visit baltic Beata Barkas
1. The following technical conditions must be met in order to cooperate with ICT system used by visit baltic Beata Barkas:
1. Internet connection,
2. web browser enabling the display of HTML documents on screen,
3. browser supporting an e-mail account,
2. visit baltic Beata Barkas shall inform Client of the possibility of recording its IP address for the purposes of Service statistics and Service enhancement,
3. visit baltic Beata Barkas stipulates that using Services may entail standard risk involved in using Internet network. It is recommended that Client undertakes appropriate measures in order to minimize the risk.

Booking a Suite
1. An updated Suite offer may only be found at www.visitbaltic.pl
2. Information on Suites placed at www.visitbaltic.pl not constitute an offer within the meaning of the Polish Civil Code
3. visit baltic Beata Barkas is the owner of copyrights to the content presented at www.visitbaltic.pl
4. Photographs are placed at www.visitbaltic.pl for reference only, in order to present Suites depicted therein.
5. In response to a query sent to visit baltic Beata Barkas using www.visitbaltic.pl website the Client receives a list of free Suites in the specified period.
6. Having received the list of free Suites, Client is authorized to select a Suite in order to make a Booking (confirmation of Booking by Client)
7. Confirmation of Booking by Client is equal to offering to placing an offer to conclude Contract. While confirming a Booking, Client is obliged to submit Personal Data such as: name, surname, home address phone number and E-mail address.
8. Confirming Booking by Client is equal to declaring that the personal data provided are complete and valid, the Client has the right to conclude Contract under the applicable legal regulations, and that the information provided do not infringe upon the rights of third parties.
9. Confirmation of Booking by visit baltic Beata Barkas means that the offer has been accepted and results in Contract being concluded. Conclusion of Contract is equal to the obligation to make an advance payment in the amount of 30% of total costs of the stay. The advance payment should be made within 3 days, unless otherwise agree, to the bank account indicated by visit baltic Beata Barkas.
10. In the case of failure to make the advance payment within the indicated deadline, visit baltic Beata Barkas has the right to withdraw from Contract without setting an additional payment term. Withdrawal from Contract is effective from the moment when Client receives an e-mail informing of the withdrawal from Contract.
11. The outstanding amount for the stay is paid by Client either prior to arrival via wire transfer to the account of visit baltic Beata Barkas or in cash (in PLN or equivalent amount in EUR) on the day of arrival. The advance payment is credited towards the price.
12. The minimum duration of stay is two days subject to the following reservation:
1. in the period from July 4th to August 23rd of the given year and on the New Year’s Eve – the minimum duration of stay is three days.
2. during the so-called long weekends (i.e. when a red-letter day is on Thursday, Friday, Monday or Tuesday of a given week) the minimum duration of stay is three days
13. For group Bookings, the person who concludes the Contract should indicate all his/her required Personal Data, if this was not done upon the confirmation of Booking. At the same time this person acknowledges having third-party responsibility for the execution of Contract.

Rental prices
1. The applicable rental prices of Suites are only published at www.visitbaltic.pl
2. The applicable amounts of additional fees (final cleaning, parking lot, pets, tourist tax, additional bed) are only published at www.visitbaltic.pl
3. The Suite rental prices published at www.visitbaltic.pl are in Polish zloty (PLN) and include VAT in the amount applicable as of the date of Contract conclusion.

Arrival and departure of customers
1. Customers are expected on the arrival day (i.e. as specified as the beginning of rental period) between 4pm and 6 pm in office visit baltic - located on Wojska Polskiego Street 4ab/5a in Świnoujście. Customers should vacate the apartment by 10am on the last day of the rental period. Collection and deposit of keys takes place in the main office visit baltic.
2. It is possible to set an individual arrival time and agree collection of the key.
3. The customer is obliged to inform visit baltic Beata Barkas if they wish to bring a pet. Such customers will be offerd apartments were pets are allowed. Information about such apartments is available on the website www.visitbaltic.pl

Rules of stay
1. At www.visitbaltic.pl the description of each Suite includes information regarding the maximum number of people allowed at the Suite and whether pets are accepted. Client is obliged to comply with these rules, respect the property of Suite owners and obey by the general standards of public order, in particular respect the quiet hours from 10 pm to 10 am the following day. Should excessive number of guests, devastation or gross violation of public order be found, visit baltic Beata Barkas has the right to terminate the contract with immediate effect without cost reimbursement.
2. Client is obliged to properly secure the Suite, i.e. take care to close entrance door and windows whenever leaving is and store the keys to Suite in a way that would prevent access of strangers,
3. Client is not authorized to rent Suit to third parties,
4. In case of reservations to the cleanliness of Suite or discovering technical defects in Suite, Client should immediately inform visit baltic Beata Barkas.
5. If Client, after or during the execution of Contract, finds faults in the execution of Contract, Client has the right to file a complaint with visit baltic Beata Barkas.
6. Client filing a complaint is obliged to attach a written statement including the following data: claimant data – name and surname or company name, home or company seat detailed address and e-mail address, date of Contract execution, detailed fault description and the circumstances in which it occurred, claimant’s demands.
7. Complaints are considered by visit baltic Beata Barkas within a maximum of 14 days from Contract execution date.
8. If complaint is recognized by visit baltic Beata Barkas, visit baltic Beata Barkas shall return the equivalent of contractual price to Client or propose another solution.
9. If the conditions of complaint procedure are infringed upon, the complaint must not be recognized,
10. Earlier departure provides no basis for the reimbursement of the cost of stay, or a part thereof.
11. Client is liable for any damage done in Suite.
12. Smoking is completely banned in all Suites. Smoke detectors might be installed in Suites. Activation of fire alarm may result in Client being charged for the intervention of fire brigade or security company
13. visit baltic Beata Barkas may not be held liable for any mistakes (including substantive and linguistic errors) or any breaks (temporary and/or partial) in the operation of www.visitbaltic.pl website related to failure, repair, update or maintenance of our website.
14. In accordance with the limitations included herein, as well as in accordance with the applicable law, visit baltic Beata Barkas is only responsible for covering direct damage which has been actually suffered by Client due to visit baltic Beata Barkas failure to fulfill its duty to provide Services and execute Contract and which in total amount to the total cost of Contract (regardless of whether the situation is one-time or repeated).
15. visit baltic Beata Barkas Solutions is not liable for (i) any punitive, unusual, direct or indirect damages and losses losses of production, loss of profit, loss of income, loss of contract, loss or impairment of good faith or reputation, total loss, (ii) services provided and products offered by visit baltic Beata Barkas, (iii) any (direct, indirect or punitive) damages, losses or costs suffered by Client that result from or are related to using, inability to use or delays in the operation of www.visitbaltic.pl or for (v) any injuries, deaths, property damages or other (direct, indirect, unusual or punitive) damages, losses or costs suffered by Client that do not result from actions or negligence or visit baltic Beata Barkas, including force majeure events or any other event beyond the control of visit baltic Beata Barkas.
16. In particular, visit baltic Beata Barkas is not liable for external phenomena hinder the use of Suite, in particular construction works (including repair works) ongoing in the neighboring apartments or buildings, or noise caused by other factors.

Booking cancellation or failure to arrive. Changes in Contract conditions.
1. Client should inform visit baltic Beata Barkas of a change in or cancellation of Booking in writing via e-mail, fax or traditional mail.
2. If Client cancels Booking, the advance payment is not returned, except for the event when visit baltic Beata Barkas accepts another booking for the same Suite in the same period and on the same financial conditions. In such case the sum paid in advance is returned within 7 days after the execution of new Booking.
3. Should Client fail to arrive or contact on the agreed date o arrival, the Suite is vacated for Re-Booking on the following day.
4. If Booking is canceled less than 30 days prior to arrival, Client is additionally obliged to reimburse the costs suffered by visit baltic Beata Barkas in the amount up to 90% of stay costs.
5. If visit baltic Beata Barkas accepts another booking for the same Suite in the same period and on the same financial conditions, Client is released from the aforementioned obligation.
6. Insurance against Booking cancellation is recommended.
7. visit baltic Beata Barkas reserve the right to withdraw from contract or offer another Suite if, due to objective circumstances (force majeure) it is not possible to use the booked Suite. If the replacement Suite does not meet Client's expectations, Client has the right to withdraw from rental contract, and the amount paid in advance is returned in 100%.
8. visit baltic Beata Barkas reserve the right to withdraw from contract or offer another Suite in the case of overbooking, i.e. when by mistake, contracts with at least two Clients are concluded with respect to the same Suite for the same period. In such case, withdrawal from contract equals to the obligation to return the amount paid in advance to Client in 100%. If the replacement Suite does not meet Client's expectations, Client has the right to withdraw from rental contract, and the amount paid in advance is returned in 100%.
9. Should disputes ensue from the execution of Contract, the parties shall strive to resolve them amicably, and if no agreement is reached, parties shall submit the dispute to be resolved by a common court.
10. visit baltic Beata Barkas reserves the right to modify the prices published at www.visitbaltic.pl, introduce new Suites to the offer, to conduct and cancel promotional campaigns and to modify them. These rights do not impact prices under Contracts concluded prior to the date on which the change of price, promotion conditions or sale conditions comes into effect.

Privacy policy
1. Personal Data is managed by Booking System Owner.
2. The following personal data are processed: name, surname, postal address, e-mail address, telephone number.
3. Booking System Owner may process operational data in the scope of IP address for the purposes of Service statistics and Service enhancement.
4. Based on the relevant regulations of German law, Booking System Owner is entitled to process Client’s Personal Data for the purpose of Service use and Booking, and also in order to submit the data to Lodging.
5. By making a Booking, User expresses consent for their personal data being processed and uses for the purpose referred to in the above item 11.4., in particular for their data to be submitted to Lodging for the sake of Contract execution.
6. Booking System Owner ensures the safety of User’s Personal Data on the conditions defined in the relevant regulations of German law, on safe servers located on the premises of Federal Republic of Germany, coding the data in the course of commonly applied data transfer procedure.
7. Booking System Owner ensures that Personal Data submitted by User are protected against third party access and disclosure, under the provision that in specific situations the data may be disclosed for reasons dictated by Governing Law Concerning Personal Data
8. User has the right to review, correct and demand the cessation of use of their Personal Data.
9. The submission of the data is voluntary, however it is required in order to make Booking and execute Contract.
10. Clients who do not consent to the rules provided herein are requested not to use services offered via www.visitbaltic.pl

Final provisions
1. Terms and Conditions come into effect as of 1.5.2015
2. The applicable Terms and Conditions are available for User at www.visitbaltic.pl
3. visit baltic Beata Barkas reserves the right to unilaterally modify the provisions of Terms and Conditions without the necessity to justify it to User, under the provision of the following items.
4. Changes made to Terms and Conditions come into effect 7 days after the publication of their content on the website www.visitbaltic.pl
5. Bookings made and Contracts concluded prior to the entering into force of changes in Terms and Conditions are executed on the basis of the provisions of Terms and Conditions applicable as of the date of Booking.
6. The regulations of the Polish Civil Code, Act of August 29, 1997 on Tourist Services, APSEM, and, in the scope of the protection and processing of personal data – the relevant regulations of German law, apply to all matters not covered by these Terms and Conditions
7. Original Polish version of these Terms and Conditions may be translated into other languages. In case of any doubt as to the content or interpretation of Terms and Conditions or in case of discrepancies, especially discrepancies between Polish version of Terms and Conditions and any other language versions of Terms and Conditions, the Polish version prevails, since it is final and conclusive to the extent defined by the applicable legal regulations.

Privacy policy – acceptance of cookie files
1. This website uses Google Analytics, an analytic tool of Google Inc. ('Google'). Google Analytics uses the so-called cookies – text files stored on your computer and enabling the analysis of the way you use this website. Cookie-generated information pertaining to the manner in which you use this website are usually sent to Google servers in USA and stored there. Activation of an IP hiding tool on this website will result in the IP address being shortened for users from one of the countries of the European Union or from a signatory country of the European Economic Area agreement. It is only in exceptional cases that a full IP address is sent to USA Google server and shortened there. Upon the request of this website's operator, Google uses the above mentioned information in order to analyze the user's usage of the website, create reports on the traffic on sites for website operators and provide other services related to the use of websites and the Internet. 2. Regardless of the provisions of item 13.1. above, please be informed that cookie files are small text files sent by a web site and saved on a device used by the internaut. It is however worth remembering that blocking cookie files entirely may limit or prevent using some of the website's functions.
3. visit baltic Beata Barkas Intermediary uses cookie files for statistic purposes (traffic at the site and the frequency with which particular subsites are visited is analyzed in order to enable better understanding of the way Users utilize the website, and hence perfecting its content as well as functionality) and also for functional purposes (cookie files enable saving Client's personal settings, e.g. language, web site version or font size, which makes using the website faster and easier). Cookie files in no way identify User's personal data and have no influence on User's software or hardware.
4. Some of cookie files are active only when browser is being used (session cookies). Some (persistent cookies) are stored for longer periods in order to keep User selected settings and to enable the identification (at the level of website traffic analysis) of new and returning Users.
